Civil Penalty Notice for Illegal Working Employees

The British government has been under significant pressure recently to stop illegal working. To tackle this, the Home Office are issuing Civil Penalty Notices to businesses employing illegal workers. There has also been an increase in randomised audits and inspection visits by the UK Visas and Immigration (UKVI) to companies in order to find out if any illegal workers are being employed. An illegal worker would be anyone from outside the European Economic Area (EAA) working in the UK without formal permission.

A Civil Penalty Notice is a serious matter, and can ruin a business. It can result in a negative record with the Home Office, fines of up to £20,000 per illegal worker, criminal prosecution and the loss of the right to employ migrant workers.

However, when a business does receive a Civil Penalty Notice it can be appealed. Our strong Business Immigration team can help, as they are well-versed in dealing with the Home Office and appealing Civil Penalty Notices.

How to appeal a Civil Penalty Notice

First, it is very important to contact experienced immigration lawyers. Leka Solicitors have extensive experience of representing clients who face Civil Penalty Notices, and would take the time to understand the specifics of your case in order to best represent you.

On your behalf, we would write to the Home Office as your legal representatives with grounds for objecting to the Civil Penalty Notice. As we understand time is of the essence in these matters, we are committed to making these representations within 14 days of accepting your case.

Even if the Home Office does not accept your written representations, the matter does not end there. We would apply for your matter to be heard at the County Court. This would need thorough preparation, as it would be your final opportunity to have the penalty adjusted or repealed. We know how stressful attending court can be, and our experienced practitioners would assist you throughout the process.
