Stopping a claim for repossession

Last year, figures from the Ministry of Justice showed that mortgage possession claims by lenders were at their highest in five years. The cost-of-living crisis has forced many homeowners into financial difficulty, and this has caused many to struggle with their mortgage payments.

The background

This month, a client who was facing imminent eviction came to us. She had fallen into mortgage arrears of over £48,000. She also had very difficult personal circumstances including a cancer diagnosis. When we spoke to her we learnt that she had two adult children who were willing to pay off her mortgage and the arrears. However, they needed time to secure a mortgage in principal. With the eviction date looming, there was a risk that they would not be able to get a mortgage in time.

What we did

We needed to work quickly to stop this eviction. To do this, we created a repayment plan and took detailed witness statements from our client and her two children. We presented these to the Court as part of an urgent application to prevent the eviction. We also applied for Breathing Space on our client’s behalf to give her and her children time to find a mortgage in principal.

The outcome

Our application for Breathing Space was granted, and therefore the court agreed to stay the application. This has allowed our client and her children the time to find a mortgage in principal, meaning that they can keep their home.
